These terms and conditions, including the Privacy Policy, govern your use of Kelly’s Education Limited’s services and the use of Kelly’s Education Limited’s Website, located at https://us.kellys-edu.com.
By accessing this website you accept these terms and conditions and agree to be bound by them, and any amendment, variation, updates thereto, which may from time to time be posted on Kelly’s Education Limited’s Website. Do not continue to use Kelly’s Education if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Policy: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Hong Kong, Special Administrative Region. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

B. Classes, Cancellation, Payment etc
Classes
Information on course packages are published, from time to time, on Kelly’s Education Limited’s website. To purchase a course package, you must (i) be at least 18 years old; (ii) have read, understood and accepted the terms and conditions herein, and agree to be bound by any amendment, variations, and updates thereto, which shall from time to time be posted on Kelly’s Education Limited’s Website.
Classes are conducted live over Kelly’s Education Limited’s website by an independent contractor appointed by us. The classes will be provided by a live 1-on-1 , or in a group of not more than 4 students to a teacher. Each session will generally take [25] minutes, unless we otherwise agree with you in writing.
Prior to the star of each course, we will determine the language proficiency level of the student through the use of an assessment test. The student and his/ her parent/ guardian agrees to the use of the assessment test and to be bound by the results of the assessment test.
Classes may be recorded for training purposes. By proceeding with this agreement, you agree to the recording of each class session. You may revoke this consent by sending an email to info@kellys-edu.com, and we will delete existing videos and stop recording future classes.
Class packages are specific to a student and non-transferrable and non-assignable.
Payment
By accepting these terms and conditions, you agree to be solely responsibility for payment of course fees for the selected course package.
If payment is made by credit card, you warrant that you are authorized to use the said credit card, to supply information of the credit card, and authorize use to charge your credit card on a regular basis to pay for course fees as they fall due.
Cancellation and refund policy
Cancellations for classes must be informed within 24 HOURS in advance of the schedule start time for the class. The class may then be scheduled to a date and time mutually acceptable to the teacher and student but which shall be no later than thirty(30) days from the date of the original class failing which the course fee for that class shall be forfeited and the student shall not be entitled to a refund for that class. Lesson will not be refunded if it is within 24 hours to the class start time.
We respect the time of both the student and instructor. It follows that a no-show by a student shall result in the deduction of one class from the class package.
Kelly’s Education shall refund the entire course fees paid by the student if:
- It does not commence the course on the course commencement date, and informs us within seven (7) days in advance of the start of the course; or
- the student fails to pass the proficiency test for the level of course it signed up to.
Intellectual Property and Curriculum
No sharing of curriculum
The student agrees to respect Kelly’s Education’s intellectual property rights including those in respect of the Curriculum and shall not share, publish or disseminate the curriculum used by Kelly’s Education during the course to third parties without Kelly’s Education’s prior written consent.
C. Intellectual Property, Website etc
License
Unless otherwise stated, Kelly’s Education Limited and/or its licensors own the intellectual property rights for all material on Kelly’s Education. All intellectual property rights are reserved. You may access this from Kelly’s Education for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
- Republish material from Kelly’s Education
- Sell, rent or sub-license material from Kelly’s Education
- Reproduce, duplicate or copy material from Kelly’s Education
- Redistribute content from Kelly’s Education
This Agreement shall begin on the date hereof.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Kelly’s Education Limited does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Kelly’s Education Limited,I ts agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, Kelly’s Education Limited shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

Governing law and jurisdiction

In the event of a dispute arising out of or in connection with these terms and conditions or the Privacy Policy, parties agree to resolve the dispute through amicable negotiations. If amicable negotiations are unable to yield a resolution within three months from the date either party notifies the other (in writing) of a dispute, the dispute shall be referred to the courts of the Hong Kong, Special Administrative Region, which shall have exclusive jurisdiction over all disputes arisng hereunder.
